Terms, conditions and returns policy
Sarh Al Ettifaq Contracting · Version 15 September 2026
Read these terms together with the approved quotation or contract. Activity-specific terms apply to the relevant transaction. Warranty periods, delivery times and payment plans are specified in the transaction document. Mandatory statutory rights remain protected.
General terms
- Prices are in Saudi riyals and exclude VAT unless stated otherwise. VAT is added at the applicable statutory rate. Quotations remain valid for 15 days from issue unless the quotation states otherwise.
- The customer's signature, stamp, purchase order or advance payment constitutes acceptance of the prices, scope and terms of the quotation.
- Work begins after receipt of the purchase order and advance payment and handover of the site or equipment, as applicable. Estimated delivery periods start when the site, materials, approvals and due payment are available.
- Work and materials not expressly listed are additional and require customer approval of their cost before execution. Amounts may not be deducted or withheld without a written agreement.
- Supplied equipment and spare parts remain the establishment's property until paid for in full, to the extent permitted by law.
- The customer provides electricity, water, permits and site access unless the quotation states otherwise. The establishment is not responsible for delays caused by force majeure, supply, shipping, approvals or an unprepared site.
- Disputes shall be resolved amicably where possible; otherwise, they shall be referred to the competent judicial authority in Saudi Arabia under applicable law. These terms do not limit mandatory consumer or customer rights.
Spare parts and returns
- Confirm the equipment name, manufacturer, model, serial number and part number before ordering. The establishment is responsible for compatibility when provided with accurate and complete information.
- Special-order or imported parts ordered for the customer cannot be cancelled or returned after confirmation, except for a proven manufacturing defect or supply error, subject to statutory rights.
- Electrical and electronic parts cannot be returned after installation or use except for a manufacturing defect covered by warranty, subject to statutory rights.
- Parts carry the manufacturer's or supplier's warranty. Removal, installation and transport are excluded unless expressly included. Misuse, unstable power, liquids, breakage, third-party installation and unauthorized modification are excluded.
- Replaced parts belong to the customer unless supplied under an exchange scheme or the supplier requires their return.
Maintenance and repair
- Inspection and diagnostic fees are payable whether or not the customer approves repair, unless otherwise stated. Spare parts and consumables are excluded unless clearly listed.
- If further faults appear during dismantling or testing, the customer is informed of their cost for approval before work proceeds.
- The maintenance warranty covers only the repaired fault for the period stated in the invoice or report. It excludes new faults, misuse, power fluctuations, tampering and intervention by another party.
- The customer inspects the equipment on collection and signs the completion or maintenance report. If collection is delayed more than 30 days after notification, storage fees apply after notice as specified in the quotation or repair order.
- The customer must back up data and software before handing over equipment. The establishment is not responsible for their loss, subject to the agreed terms and statutory rights.
- Medical equipment requiring calibration or safety testing is not ready for clinical use until the required tests are completed and documented. Equipment must not be operated before formal handover and approval of the maintenance report.
Equipment supply and warranty
- Only the specifications and accessories listed in the quotation and invoice are included. Equipment condition is stated as new, refurbished, used or demonstration stock.
- Warranty starts on delivery or installation for the period specified in the quotation. It covers manufacturing defects, excluding consumables, misuse, breakage, power fluctuations and customer transport.
- Installation, commissioning and training are included only if stated in the quotation. The customer must prepare the site to the technical requirements. An unprepared site may extend delivery times and incur visit or storage fees according to the quotation.
- Equipment is inspected on delivery. Signing the delivery or commissioning record confirms receipt in the agreed condition and specification without prejudice to latent defects.
- Equipment cannot be returned after installation or use except under warranty, for nonconformity with agreed specifications or under statutory rights. Batteries, probes, sensors and consumable accessories are subject to the manufacturer's warranty and conditions of use.
Contracting and site works
- The scope is defined by the quotation, bill of quantities and approved drawings. Quantities are estimated and charged according to approved actual quantities unless a lump sum is specified.
- Changes to drawings, quantities, specifications or site conditions are treated as variations affecting price and time. Rock excavation, dewatering, special waste, utility diversions and government fees are excluded unless expressly stated.
- The customer provides underground utility information, permits, drawings, approvals and a safe, unobstructed work area, and formally hands over the site unless otherwise agreed.
- Works are approved through payment certificates, handover records, reports, photographs and completed quantities. Time is extended for additional works, stoppages caused by the customer, consultant or authorities, and circumstances beyond control.
- The establishment is not responsible for defects in previous work, existing infrastructure, inaccurate drawings or another contractor's intervention. The workmanship warranty starts at preliminary acceptance and covers execution defects, excluding misuse, subsequent changes and third-party damage.
- Payment certificates become due upon approval. If payment is late, the establishment may suspend work after notifying the customer and extend the programme for the stoppage and its effects in accordance with the agreement and applicable law.
- Acceptance or actual use indicates benefit from the works while preserving the right to record observations and defects under the contract and applicable law.
